Another company offering to buy lease

Hello,

If there is a tower on your land leased by Rogers (with a clause stating you must extend the lease until 2030) and AT&T has approached you asking to buy the lease. Is there anyway this is possible?

Contractually you are obligated to renew with Rogers. But AT&T has offered a lump sum of money that seems like a better offer then what Rogers currently pays. I guess the question is really is there anyway out of the Rogers lease/ anyway to accept AT&T's offer?

What does your Rogers lease agreement say?

Hi Nadine,

Sorry I missed this question that you posted last week. Check your Rogers cell tower lease agreement to see if there is a Right of First Refusal clause or provision. If you have an offer from AT&T to do a lease buyout or perhaps from a third party company representing AT&T or Crown Castle, you may have to provide Rogers with the terms of that offer. It all depends on what your lease says. If AT&T or other entity buys the lease (they are buying an easement to receive the rental stream) then the payments would transfer or be assigned over to them.
