Crown Castle Withholding Payments on New Cell Tower
by Dory
I am writing to ask for advice on behalf of my parents. They recently signed contracts/lease to allow Crown Castle to build a cell tower on their property in central coast California. Crown Castle was supposed to start monthly payments when they broke ground but have not made any payments at all and the cell tower has been completed. In addition, they exceeded their easement and are insisting a contract amendment even though they have not met their lease payments. What rights do my parents have? I feel that they are being taken advantage of by a large company. Thank you for any advice. Dory

For the most part we have found them to be fairly good tenants. That doesn't mean that it's always easy to deal with them. When there is a lease dispute it's often because landlords did a less than good job negotiating the lease. However it very well can be that there is a default situation and perhaps Crown has not been noticed correctly. You probably want to avoid any legal tussle with them and see if the issue can be resolved with their lease administration group.
Please call us to discuss and see if we can help get your issue resolved.
