We currently are negotiating with a Cell Tower Construction company about erecting a 400 ft tower on our property in NW Florida near the Alabama line. We requested a basic lease from the Cell Tower Company thinking this would be from a Telecommunications Company (Verizon, Sprint, AT&T, etc.) that would be using the tower. Instead it is a lease from the Cell Tower Company.
Questions
1. Is this the usual procedure to negotiate with the Tower Construction Company first about lease terms even though there is no Telecommunication Company listed to use the tower?
2. Do we negotiate with the Tower Construction Company anticipating use by a Telecommunications Company at a later date and should we request from the Tower Construction Company when do they anticipate when that would occur?
You are dealing with the developer who has inside information and a contract or letter of intent from at least one carrier. Or perhaps they have a cousin running the real estate department at Verizon or something. In your lease the tower developer is the Lessee. They will build the tower for the carrier (Verizon, T-Mobile etc) and then flip it to a big tower management companies like American Tower, Crown Castle, or if you are really unlucky, to SBA out of Boca Raton.
Their objective is to give you the worst possible lease that will allow them to flip the tower for the most possible return. Then they rinse and repeat this process a dozen times.
