In Albuquerque NM i have an American Tower site on my property with a prepaid lease for 50 years it requires special use zoning. My special use zoning expired after 15 years I applied for renewal of the zoning but it was denied because the tower company had not closed some of its construction papers now the county is requesting the tower be removed due to lack of proper zoning. Am i obligated to return to zoning to try and special use zone the property again or should i ask american tower to remove its tower or should i ask for compensation to go back and try and resolve the zoning issue after it has expired. My recommendation is to send American Tower official notice as to what is going on and let them get involved. You will most likely have to assist them by signing some documents but that should be the extent of your responsibility. Their regional attorneys will take care of this and the municipality will be hard pressed to actually force them to take the site down.
