Hi,
Can anyone advise if the income earned from the rental of Cell towers is taxable for NYS sales tax? I have looked around for guidance and have found that it is taxable on the federal level, but have not found anything regarding NYS.

Agreed! The problem is, I am a CPA, and i cant get a clear handle on it. I called the state and they mumbled some guidance that does not necessarily relate directly to this, but it may actually be accurate. They said that it falls under the category of rental of real property, which is tax-exempt. The thing is - what if they use a utility room for their equipment as part of the towers - where now, it is also rental of personal property...
