U.S. Cellular does not want to sign a lease extension with us because they are claiming they need to have a Right of First Refusal in the event I want to sell my lease for cash. This is an old cell tower that they have utilized for almost 20 years without a Right of First Refusal in their current lease. How important is this to get in the contract?
US Cellular wants to have the right of first refusal to buy the lease revenue stream, and most property owners will sadly end up giving it to them. When this happens property owners lose out. Why? Do you think that a company will bend over backwards to make you an awesome offer for your cell tower lease if they know that US Cellular has the right to match their offer and offer you a dime more and get your lease.
USA is still a free market capitalist system not a Socialist country.... but who know for how much longer? Giving the carrier the ROFR is not consistent with a free market system and IMHO should not be given to them. Of course they use this as a bargaining chip. Tell them to "man up" and play nice in the sandbox with everyone else and make you an offer you can't refuse if and when you sell this.
